USA - Cole Bishop Amendment a step forward into making the vaping business easier

The US it seems is taking a step forward into making the vaping business easier for both consumers and suppliers.  Some of you may not be aware of the launch date set by the Food & Drug Administration (FDA) whereby all E-Cigarette products need to go through an application and very lengthy process to continue selling into the market.  The original date was 15 February 2007, whereby nearly all vaping products and companies didn’t even exist.  Which means that every single vape product after this date will need to go through the premarket intense application process.

One US congressman, Tom Cole, thought that this wasn’t a fair date after receiving many calls and letters regarding this date.  He created a bill to this ruling whereby the date should be changed. He went on to say that “It seems to me like we’re regulating out of fear instead of out of knowledge”. A similar amendment was also introduced by Tom Cole and one of his cosponsors Sanford Bishop – hence the Cole/ Bishop Amendment.

Some of the supporting comments were:

“The FDA is effectively making it more difficult to bring a vapor product into the market than a cigarette.”

“Many vapor products play an important role in harm reduction.”

“Let’s support those who are looking for less harmful alternatives to smoking.”

The amendment still has to reach the House Committee and then finally on to the President, but in essence the 31-19 vote is a positive step closer.

Will this effect the UK and Europe regulations set by the TPD? Will be interesting to see but it could take a while to get to the House Committee and a decision made.  Watch this space.
